General Terms and Conditions
1 Scope of Application
These General Terms and Conditions apply to all orders placed through the online shop at www.enuneskin.com. The contractual partner is Scentframe – Stefan Kehl Pfuelstr. 2 10997 Berlin Germany E-mail info@enuneskin.com. The offers are directed exclusively at consumers within the meaning of Section 13 BGB (German Civil Code).
2 Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer. By clicking the "Buy" button, you place a binding order. After receiving the order, you will receive an automatic order confirmation by e-mail, which does not yet constitute acceptance. The contract is concluded through an explicit order confirmation or by shipping the goods. Should a product not be kept in stock, we reserve the right to send the goods in one or more partial deliveries or to reorder in case of delivery bottlenecks. In this case, we will inform you immediately and arrange for delivery if possible.
3 Prices and Shipping Costs
All prices include the statutory value-added tax. Shipping costs are shown separately during the order process. For deliveries outside the European Union, additional customs duties or fees may apply, which are to be borne by the customer.
4 Payment
Payment is due immediately upon conclusion of the contract. The available payment methods are displayed in the online shop.
5 Delivery
We deliver nationally and internationally. Delivery times are specified in the online shop. Unless otherwise stated, the processing time is usually two business days. Should a product not be available, we will inform you immediately. In this case, no contract will be concluded.
6 Retention of Title
The goods remain our property until full payment has been received.
7 Right of Withdrawal
Consumers have a statutory right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The period begins on the day on which you or a third party designated by you took possession of the goods. To exercise the right of withdrawal, a clear declaration by e-mail to info@enuneskin.com is sufficient. A sample withdrawal form can be found in the "Right of Withdrawal" section of our website. To comply with the withdrawal period, it is sufficient to send the declaration of withdrawal in good time. In the event of a withdrawal, we will refund all payments within fourteen days from receipt of your declaration. We may refuse repayment until we have received the goods back. You bear the direct costs of returning the goods. The right of withdrawal does not apply to sealed goods for health protection or hygiene reasons if the seal has been removed, nor to custom-made or perishable goods.
8 Warranty
The statutory provisions on liability for material defects apply.
9 Liability
We are fully liable for damages resulting from injury to life, body, or health. For other damages, we are only liable in cases of intent or gross negligence. In cases of slight negligence, we are only liable for the breach of essential cardinal obligations and limited to foreseeable damages. The provisions of the Product Liability Act remain unaffected.
10 Vouchers and Promotions
Vouchers can only be redeemed within the specified period. Cash payment is excluded. Freebies are provided voluntarily and only while stocks last.
11 Set-off
A set-off is only permissible with undisputed or legally established claims.
12 Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
13 Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
